PERSONAL DATA PROTECTION CHARTER
In accordance with European Regulation 2016/679 of April 27, 2016 (known as the “General Data Protection Regulation” or RGPD).

This Charter has been drawn up to inform you of the practices and conditions under which www.vica.fr collects, uses and stores your personal data (hereinafter referred to as the “Data”).
You will find a description of the various “Data” that we may collect and process or that you may transmit to us when you access and/or use the https://www.vica.fr site (the “Site”) on which our products are sold. The term “Site” refers only to the https://www.vica.fr website.
Given the constant evolution of laws and regulations concerning technology and the protection of personal data, it is likely that the present Charter will be updated. If you are a user of the Site, you will be informed of any changes by e-mail.
If any clause of the present Charter should be declared invalid or contrary to regulations, it will be deemed unwritten, but this will not invalidate the other clauses of the present Charter.
The present Charter applies to “Collected Data”:
By simply browsing the Site.
Via e-mails exchanged between you and www.vica.fr or any other electronic messaging tool.
When you create a user account on the Site.
When you subscribe to the Site Newsletter (the “Newsletter”).
It does not apply to information collected by any third parties or via sites managed by them, including via applications or content (including advertisements) redirecting the user to the Site.
We thank you for reading carefully the Charter concerning the processing of your Data and we inform you that browsing our Site necessarily implies acceptance of this Charter.
If the latter does not obtain your approval, we invite you to leave our Site. It is your responsibility to check that the Data communicated to www.vica.fr are correct.
1. WHAT DATA IS COLLECTED BY www.vica.fr?
Depending on the nature and purpose of your interaction with www.vica.fr (creation of a user account, subscription to the Newsletter, completion of contact forms, as well as during any telephone exchanges) we are likely to collect the following Data:
Your e-mail address will be required if you wish to create a user account, communicate with us via the contact forms and/or receive our newsletter.
Data relating to your identity such as your surname, first names, e-mail address, postal addresses and telephone numbers may be requested.
Browsing data: this is data relating to the way in which you use the Site, including: IP address, browser used, browsing time, search history, operating system used, language and pages viewed.
Data concerning your visits to the Site, including traffic data, log files and other data or communication resources that you use when accessing the Site.
Data relating to orders: your postal address is required for invoicing purposes. Similarly, your bank, PayPal or other financial partner details must be provided in order to proceed with the payment of your order.
Data relating to the use of social networks when you use their functionalities.
2. HOW IS YOUR DATA COLLECTED?
Data may be collected in various ways on the Site. Data may be collected directly when you transfer it to us by means of the contact and user account creation forms, newsletter registration forms available on the Site and/or communicated when you contact us by telephone.
When you contact us by these various means, a copy of your exchanges with www.vica.fr, including e-mail addresses, may be made and archived. www.vica.fr also collects certain Data indirectly by means of cookies/trackers.
3. WHY IS YOUR DATA COLLECTED?
If you are an ordinary user, we collect your Data for :
To send you our Newsletter and/or personalized commercial offers if you have consented.
To manage your requests sent via the contact page.
To inform you of changes concerning the Site or our products and services.
To respect our rights and obligations stipulated in contracts concluded with users and for any other legal purpose.
We may also use cookies or tracers:
To analyze traffic and data on the Site in order to measure the number of users of the Site, to make it easier to use and to ensure its ability to respond promptly to your requests.
To secure your browsing and enable us to improve your user experience, in particular by recognizing the user name and password you have already provided so that you do not have to enter them if you connect to a private part of the Site. Refusal of these will prevent any connection to this part of the site (impossible identification).
What is a cookie?
A cookie is a text file stored on the hard disk of your terminal (computer or telephone) at the request of the server managing the website you visit. 4. WHO PROCESSES YOUR DATA?
Your Data are processed by www.vica.fr staff and associates in charge of :
Management of orders
Management of support, to answer all your questions.
Sending of the newsletter if you have authorized us to do so.
In addition, within the framework of our activity, and for processing purposes, your Data may be communicated to subcontractors, service providers or other third parties, and in particular :
Mailjet (for emailing).
Google Analytics (for website audience analysis).
Each of these players respects a confidentiality agreement concerning the use and processing of personal data.
To send out our newsletters, our e-mailing campaigns are managed by MAILJET – SAS with capital of €69,367.55 – RCS Paris 524 536 992 00059 – Intracommunity VAT no. FR 675 245 369 92 – Head office: 13-13 bis, rue de l’Aubrac – 75012 Paris – FRANCE.
All of the above-mentioned subcontractors, service providers, partners or other third parties are bound by contractual obligations to respect the confidentiality and protection of Data and to process it solely for the purposes for which we transfer it to them.
Your Data may be transferred to any purchaser or other successor in the event of a merger, assignment, restructuring, reorganization, dissolution or other sale or transfer of some or all of www.vica.fr’s assets due to uncertainties or bankruptcy, liquidation or other processes in which www.vica.fr’s User Data is one of the transferred assets.
Finally, we may also disclose your Data :
To comply with any mandate required by applicable laws, including governmental and regulatory requests.
If we believe that disclosure is necessary or required to protect the rights, property or safety of www.vica.fr, its customers or other stakeholders. This possible disclosure includes the exchange of information with other companies and organizations for the purposes of protection against fraud and counterfeiting.
The Site may contain links to various sites and social networking platforms managed on third-party servers, by persons or organizations over which www.vica.fr has no control.
As a result, we cannot under any circumstances be held responsible for the way in which your Data will be stored or used on the servers of these third parties. We advise you to read the applicable privacy policy of each third-party website you access via the Site in order to understand how your Data will be used.
5. HOW LONG WILL YOUR DATA BE KEPT?
www.vica.fr retains your Data only for as long as is necessary for the purposes set out in Article 3. This retention period is not the same depending on the Data in question, as the nature and purpose of the collection may vary. Similarly, certain legal obligations impose a specific retention period.
When you subscribe to our newsletter, we keep your e-mail address until you unsubscribe.
When you contact SITE NAME using the contact form or by telephone, your data may be stored:
Up to one (1) year from the last contact if you do not have a customer account or have not placed an order on the site or with our company.
Up to ten (10) years (legal duration) from the last order placed on the Site, if this information concerns this order.
In all other cases, the Data exchanged will not be kept for more than three (3) years.
If you request the deletion of your Personal Data, your Site user account will be deactivated and anonymized, and then completely deleted at the end of the aforementioned periods from the day on which you made the request. Finally, data collected by means of cookies or tracers will be kept for up to six (6) months in the case of audience measurement cookies or tracers, and for up to thirteen (13) months in the case of other cookies or tracers. Beyond the above-mentioned retention periods, your Data will be anonymized and stored exclusively for statistical purposes.
6. HOW IS YOUR DATA PROTECTED?
Your Data is stored on a secure server protected by a firewall and antivirus software. We have implemented technical and organizational measures to guarantee the security and confidentiality of your Data against accidental loss and against unauthorized access, use, modification and disclosure. However, given the inherent characteristics of the Internet, we are unable to guarantee the optimum security of information exchanges over this network.
We strive to protect your Data, but we cannot guarantee the absolute security of information transmitted to the Site. You agree that you transmit your Data at your own risk.
We cannot be held responsible for non-compliance with the confidentiality parameters or security measures in place on the Site.
In this respect, you agree that the security of your information is also your responsibility. For example, it is your responsibility to keep secret the password that gives you access to your user account. Do not, under any circumstances, divulge it to third parties. Similarly, please be careful when disclosing information in the public sections of the Site, as these may be consulted by any user of the Site.
7. WHAT ARE YOUR RIGHTS?
You can choose how the Data you send us are used:
You may browse the Site without providing any Data. In this case, you will not be able to use certain features of the Site, and in particular, to make purchases (if you are a simple user) and/or downloads on the Site.
You can decide to no longer receive the Newsletter and our personalized offers: simply click on the link in any e-mail sent to you.
In addition, subject to the conditions laid down by the aforementioned regulations for the exercise of these rights, you benefit from :
A right to the deletion of your Data (except accounting data for which retention of 10 years is required by French law – Article L123-22 of the Commercial Code).
A right to the limitation of the processing of your Data.
A right to object to the processing of your Data for legitimate reasons, in accordance with Article 21 of the RGPD.
Of a right to portability over the Data you have provided (for automated processing based on consent or the performance of a contract).
Of a right to withdrawal of consent, where this has been requested from you. Where the processing of your Data is carried out on the basis of your consent, you may withdraw it at any time.
You acknowledge, however, that processing carried out prior to the withdrawal of your consent remains perfectly valid. You also have the right to object without cause to www.vica.fr carrying out an analysis of your Data in order to share it for marketing purposes.
However, in accordance with Article 12.6 of the RGPD, in order to exercise these rights, www.vica.fr, as the data controller, reserves the right to ask you to provide proof of your identity. We inform you that the data enabling you to justify your identity will be deleted once we have responded to your request. We have a period of one month in which to respond to any request relating to the exercise of your rights. This period may be extended by two months if the request is too complex or too numerous.
